Tiffany Rad and Christopher Mooney: Failing to Make History

For some time, Tiffany Rad (attorney and conference speaker) and Christopher Mooney (low end ISP operator and conference speaker) have bloviated, no end, about a history making appeal involving the DMCA. They have asserted that the lawsuit would change the law and change history.

Small problem…it seems the lawsuit has died and gone nowhere. You can find videos on YouTube of them talking about it, so, in their (small?) minds, it was real at one point in time, perhaps.

In any case, it is a nonissue now. Tiffany Rad and Christopher Mooney have  had their 15 minutes of fame, now they can go back to whatever it was they were doing before, and it certainly was not anything interesting.

Not surprisingly, Larry Sarner, Linda Rosa, Charly D. Miller, Jean Mercer and Monica Pignotti, all of whom played various roles in the planned legal drama, have also gone silent on the matter. Like Rad and Mooney, they have faded into obscurity (not that they were ever famous to begin with).

§ 18.2-500. Same; civil relief; damages and counsel fees; injunctions.

A. Any person who shall be injured in his reputation, trade, business or profession by reason of a violation of §  18.2-499, may sue therefor and recover three-fold the damages by him sustained, and the costs of suit, including a reasonable fee to plaintiff’s counsel, and without limiting the generality of the term, “damages” shall include loss of profits.

B. Whenever a person shall duly file a civil action in the circuit court of any county or city against any person alleging violations of the provisions of §  18.2-499 and praying that such party defendant be restrained and enjoined from continuing the acts complained of, such court shall have jurisdiction to hear and determine the issues involved, to issue injunctions pendente lite and permanent injunctions and to decree damages and costs of suit, including reasonable counsel fees to complainants’ and defendants’ counsel.
